The following turtles have been listed as Imperiled Species (meaning endangered or threatened) by the State of Florida. Authority to regulate and create rules relating to these species is given to the FWC under the state Endangered Species Act (chapter 372.072)

Rules Relating to Imperiled Species (Code sections)

68A-27.001 - No person shall kill, attempt to kill, or wound any endangered species

68A-27.003(1) - No person shall pursue, molest, harm, harass, capture, possess, or sell endangered species, their parts or nests *this only applies to the Lower Keys Striped Mud Population*

68A-27.005(1) - (a) No person shall take, possess, transport, or sell any species of special concern, their parts, or nests; (b) Section (a) applies to the alligator snapper, Suwannee cooter, Barbour's map, and gopher torts

Administrative Code Sections (Regulations made by the FWC)

68A-6.0022(2)(a) - Turtles are a Class III wildlife and do not require a permit to possess (with certain exceptions), when kept as personal pets

68A-6.0023(1) - No person shall maintain captive wildlife in any unsafe or unsanitary condition, or in a manner which results in threats to the public safety or the maltreatment or neglect of such wildlife

(6) - Freshwater turtles may be taken manually, or by baited hooks, bow, dip nets, traps designed so that freshwater fish can escape, or by spearing during daylight hours. Use of bucket traps, snares, and firearms is prohibited. No person shall buy, shell, or possess for sale any alligator snapper (Macroclemys temmicki), box turtle (Terrapene carolina), Barbour's map (Graptemys barbouri), Escambia Rive map (Graptemys ernsti), DBT (Malaclemys terrapin), river cooter (Pseudemys concinna), or loggerhead must (Sternotherus minor). No person shall possess more than 2 Barbour's maps, 2 Escambia River maps, 2 DBTs, 2 box turtles, 2 loggerhead musks, or 1 alligator snapper, unless authorized by permit. River cooters cannot be taken from 4/15-7/31.
(7) - No softshell turtles (Apalone) may be taken from the wild during 5/1-7/31
(8) - No personal shall possess more than 50 eggs taken from the wild in the aggregate of species of freshwater turtle native to Florida, exccept as authorized by permit.
(9) - No person shall buy, take, sell, or possess any gopher tort (Gopherus polyphemus) unless authorized by permit
(10) - Possession of gopher torts may be authorized by permit when the owner can demonstrate that the tort(s) were legally acquired and possessed before 7/1/98
(11) - No person shall possess turtles or torts on which paint has been applied to the shell or body. Water-soluable, non-toxic identifying markings may be used in turtle racing contests
(15) - No leopard torts (Geochelone pardalis) or sulcata torts (Geochelone sulcata) shall be imported or transported into Florida without a permit. Basis for a permit shall include: (a) Each shipment is accompanied by a vet certificate stating that all speciments are free of parasites; (b) Shipping containers are incinerated within 24 hours; © Other conditions as necessary to ensure that no tort has ticks capable of transmitting Heartwater disease.
